InkOS Terms of Use

Version 1.1

This is a translation of the Portuguese version (Termos de Uso).

1. About InkOS and these Terms

InkOS is a platform of creative and artificial intelligence tools for the world of tattooing, including image creation and editing, composition development, reference preparation, stencils, resolution upscaling, 3D features and educational content, according to the plan purchased.

The platform is operated by 43.035.086 CARLOS VINICIUS DE SOUSA MELO, registered with the CNPJ (Brazilian company registry) under no. 43.035.086/0001-09, with business address at Avenida Moinho Fabrini, nº 385, bairro Independência, São Bernardo do Campo - SP, CEP 09861-160.

These Terms govern access to and use of InkOS, together with the Privacy Policy and the conditions presented at the time of purchase.

Features identified as “coming soon” represent future functionality and should not be considered available at the time of purchase.

2. Registration and account security

To purchase InkOS, the user must be at least 18 years old and have the legal capacity to enter into contracts, or act through a legal representative where permitted.

The user must provide correct information, keep their data up to date and protect their access credentials. Use on behalf of a company requires authorization to represent it.

It is not permitted to resell access to the account, share credentials to get around plan limits, or use third-party accounts without authorization.

Suspected unauthorized access must be reported to support. InkOS also remains responsible for the security measures that fall to it.

3. Plans and features

InkOS offers plans with different amounts of credits, storage limits and benefits. Prices, currency, billing frequency and applicable conditions will be shown before the purchase is confirmed.

The configuration planned in this version is:

PlanCredits/monthStorageMain benefits
Lite1202 GBWorkflows, except 3D Studio; Academy and support
Creator3005 GBLite benefits, 3D Studio, priority generation and support
Pro75010 GBCreator features, with more credits and storage

The Academy includes the tutorials and advanced technique content made available on the platform. Access does not authorize its reproduction or resale.

Generation and support priority does not mean instant processing or a fixed response time, unless expressly stated.

Any free trials or promotions will have their own conditions, presented at the time of the offer.

4. Credits and consumption

Credits are units for using InkOS features. They are not currency, an investment or a balance freely transferable between users. This definition does not override legal rights to refunds.

Consumption depends on the tool, engine and operation selected and must be shown before execution.

The initial configuration is:

Engine or actionConsumption
GPT Image 2.51 credit per action
InkOS Image1 credit per action
InkOS Image Pro2 credits per action
Nano Banana Pro3 credits per action
Topaz - Upscale 4K5 credits
Meshy - 3D generation10 credits

Creation, editing, variation and stencil may have different consumption depending on the engine used. New generations requested by the user, including new attempts with changes to the request, may consume credits again.

Plan credits are renewed every monthly cycle and do not accumulate. On renewal, the remaining balance of plan credits expires and is fully replaced by the new monthly quota. Without renewal of the subscription, there will be no new quota, and the plan balance expires at the end of the paid cycle. The renewal date must be available in the account.

Top-up credits are valid for 60 days from the date of each purchase. After that period, the unused balance of that purchase expires. Plan and top-up balances are separate: the monthly renewal does not reset top-up credits that are still valid. The validity of each purchase must be shown before purchase and made available in the account.

Cancellation or non-renewal of the subscription does not eliminate top-up credits that are still valid. The user may use them until the end of the 60 days from purchase, or until the balance runs out, whichever comes first. The end of the subscription does not restart or extend this period.

During this period without an active subscription, top-up credits allow use of the tools corresponding to the last plan purchased: Lite without access to 3D Studio; Creator and Pro with access to 3D Studio. Holding top-up credits does not expand the plan's permissions or create a new monthly quota.

Technical failures that prevent delivery of the result must be verified by support and, once an improper charge is confirmed, the credits will be refunded. Simply preferring a different result does not, in itself, constitute a technical failure, without prejudice to the rights applicable in the event of a defect in the service.

5. Payments, renewal and cancellation

The user will have access to the total price and the billing currency before confirming the purchase. Any currency conversion and card issuer charges depend on the conditions of the payment method.

For subscriptions with automatic renewal, this condition will be prominently shown at checkout. The charge will occur every cycle until cancellation.

Cancellation may be requested through the channels provided by InkOS and will prevent further renewals. As a rule, the subscription benefits will remain available until the end of the period already paid, except for refund cases or other situations provided for by law. After that period, the use of top-up credits that are still valid will follow section 4, and the retention of images will follow section 12.

The right of withdrawal for online purchases will be respected, where applicable, including the legal period of seven days and the refund of amounts due. The use of credits will not automatically be treated as a waiver of this right.

Outside the cases provided for by law or specific conditions of the offer, cancellation does not entail an automatic pro rata refund of the period already purchased.

Price changes will be communicated in advance and will not retroactively change charges already made.

6. How the artificial intelligence works

Results are produced by automated systems and may contain distortions, inaccuracies, differences from the request or similarities to other results.

InkOS does not guarantee exclusivity, absolute originality or copyright protection for every generated image.

It is up to the user to review the results before presenting them to a client, publishing them or using them in a tattoo, checking especially anatomy, hands, faces, text, symbols, proportions and suitability for the body area.

Tattoo simulations are visual references. They do not guarantee the appearance of the actual application or of the healed tattoo and do not replace the tattoo artist's technical assessment.

7. Uploaded images and third-party rights

The user must hold the rights, authorizations or other legal basis needed to upload and use photographs, drawings, trademarks, characters, images of people and other materials.

The fact that an image is available on the internet, on social networks or in Explore does not mean it is free of copyright or image rights.

When uploading photographs of clients or other people, the user must respect their privacy and ensure that the use and processing are authorized or legally permitted. The user should avoid uploading unnecessary personal information.

It is prohibited to present third-party works as one's own, remove authorship marks to conceal their origin, or use InkOS to violate copyrights, trademarks or image rights.

8. Protected characters and inspiration for tattoos

InkOS allows the use of references to protected characters and works for visual study and inspiration in developing tattoo projects, provided that the use is permitted by law and respects the rights of the respective rights holders.

This purpose does not constitute a license over the character or the work and does not automatically authorize its reproduction, adaptation, disclosure or commercial exploitation.

It is prohibited to use InkOS to sell, resell, license or commercially distribute images of protected characters or works without the necessary authorization. This includes digital files, image packs, prints, products and other commercial materials.

Generation by artificial intelligence, a change of style or a statement that the content is “inspired” does not eliminate existing rights over the original work.

Using a character in a tattoo, including in a paid service, may also require authorization. The user must assess this need before performing and publicizing the work.

InkOS does not represent and has no connection with the holders of characters or trademarks that users may mention, unless expressly stated otherwise.

9. Rights over content and results

The user retains the rights they already held over the materials uploaded. Using the platform does not transfer ownership of those materials to InkOS.

The user authorizes the technical processing needed to carry out their requests, including hosting, processing, transmission to the providers involved and delivery of the results, in accordance with the Privacy Policy.

This authorization does not include publishing the creations in advertisements, in Explore or in other public channels without specific authorization.

InkOS allows professional use of the results, including in tattoo projects, provided that these Terms, third-party rights and any specific restrictions shown before using the tool are respected.

This permission is not a guarantee of exclusivity nor a certification that the result is free of third-party rights.

10. Private library and data protection

Images and projects are private from other users on all plans. They are not automatically published in Explore.

The privacy of the library does not prevent processing by technology providers or restricted access by authorized people when necessary for support, security, operation of the service or compliance with legal obligations.

The Privacy Policy must state the data processed, its purposes, the providers involved, retention periods, any international transfers and the channels for exercising rights.

The user may request to exercise the rights provided for in data protection legislation, subject to the legal conditions and exceptions.

Any information about the use of data for model training must reflect the actual practices of InkOS and the contracted providers, as disclosed in the Privacy Policy.

11. Explore and voluntary contributions

Creating an image does not imply authorization to share it publicly.

If tasks or other forms of contribution to Explore are made available, submission will be voluntary and must state which content will be visible and how it may be used by other users.

Publication will depend on specific acceptance of the contribution conditions, including the scope of the authorization, any use in tools and withdrawal rules. These Terms, on their own, do not authorize the publication of images from the private library.

The user may only contribute materials over which they hold the necessary rights or authorizations.

12. Storage and account closure

Storage is subject to the limit of the plan purchased. On reaching the limit, the user may need to free up space or purchase a higher plan to keep saving content.

It is recommended to keep your own copies of important files. This recommendation does not remove InkOS's responsibility for the proper provision of the service.

Cancellation or non-renewal of the subscription does not automatically delete images. The library remains available for viewing and download. After one consecutive year without authenticated access to the account, counted from the last access, the images may be deleted due to inactivity. A new authenticated access restarts the count. Before deletion, the user will be notified and given the opportunity to access the account and export the files.

To downgrade, the storage used must be within the limit of the destination plan. If there is an excess, the user must delete images and files until they fit the new limit. The downgrade will only be completed after this adjustment; InkOS will not automatically choose which images to delete to carry out the change. This condition does not prevent cancellation of the subscription.

Data deletion will follow the Privacy Policy and legal retention obligations.

13. Prohibited uses

It is prohibited to use InkOS to:

The specific restrictions of the integrated engines will also be observed, with transparency about any refusals to process.

14. Availability, support and responsibilities

InkOS may undergo maintenance, updates and unavailability, including in connection with external providers. Whenever possible, scheduled interruptions will be communicated.

Relevant changes to tools or engines must be communicated. Replacing a provider does not override the commitments made in the offer or the user's rights when the contracted service is harmed.

Support will be provided through the official channels, including WhatsApp when available. Service hours and conditions will be shown on those channels.

The user is responsible for their professional decisions, for the permissions relating to the materials they upload and for reviewing the projects before using them.

InkOS is liable for the obligations that fall to it in providing the service. No provision of these Terms excludes liabilities that cannot be excluded by law.

15. Reports, suspension and termination

Reports of rights violations may be sent to contato@inkos.studio, with identification of the complainant, a description of the content, its location and evidence supporting the request.

InkOS may restrict content or suspend access when there is well-founded evidence of fraud, violation of these Terms, a security risk or a legal order.

Measures will be proportionate to the situation. Whenever possible, the user will be informed of the reason and may request a review. In urgent cases, the restriction may occur before notice is given.

Closing the account does not imply the automatic loss of amounts or credits in all situations. Any refunds and access to files will be assessed according to the circumstances, the offer and the law.

16. Acceptance, updates to the Terms and governing law

These Terms take effect for each user from their electronic acceptance. InkOS will record the version accepted and the date and time of acceptance linked to the account. The document's update date identifies its version and does not replace the individual acceptance date.

Relevant changes to these Terms will be communicated in advance, indicating the new version and the effective date. When necessary, a new acceptance will be requested.

Changes will not be used to retroactively remove rights already acquired.

Brazilian law applies, without overriding mandatory rights that apply to users in other countries. Any disputes will be submitted to the legally competent court, preserving the consumer's right to resort to the court of their domicile where applicable.
